Dear all,
Though I could not attend the conference due to
pressing engagements, my best wishes were always there. From the gist of
the proceedings that was reported as well as the email communications,
it is clear that that the conference was a success and its basic purpose
- establishment of the LEGAL FORUM with a focused agenda - has been
achieved. Lots of critical information have also been shared. I am sure
Legal Forum is proceeding as per the agenda and setting up meetings with
CJI and also pursue other
actions.
In this context I would like to revive what I had
said at the early stage of exchange of communication on the conference.
That was to mobilise men and material to put pressure on the politicians
and parliamentarians to either repeal the SARFAESI Act or the
substantially amend the same to be in consonance with the Constitution
and fundamental rights.
All of you may be aware that the BJP led government
in the centre had enacted two draconian Acts in 2002. One was POTA that
was passed in a combined session of parliament during the budget
session. This was to prevent 'physical terrorism'
and to empower the inept police force for the purpose.. The other was
SARFAESI Act, rushed through in the winter session. This was to
promote 'monetary terrorism' and to empower greedy
bankers for the purpose.
There were serious complaints of gross misuse and
abuse of of POTA leading to its repeal in 2005. Now there are several
reported cases of gross misuse and abuse of SARFAESI Act by the banks
and their 'securitisation' agents. Since there is no political outcry
against SARFAESI Act there is need to raise voice on behalf of the Small
Scale Entrepreneurs who actually are the worst sufferers.
As a first step I am in the process of drafting a
comprehensive memorandum to be addressed to the President, Vice
President, Prime Minister, Speaker of Lok Sabha and Leader of the
Opposition adducing compelling reasons either to repeal the law in toto
or to substantially amend the provisions of the Act that has turned
banks into 'shylocks'!
For the purpose I would require specific case
studies of gross misuse or abuse of the SARFAESI Act and manipulation of
the DRT/legal mechanism by the banks and their agents. If you agree you
may mail these 'case studies' to me that should be descriptive at the
same time as brief as possible.
