Dear all,

Though I could not attend the conference due to pressing engagements, my best wishes were always there. From the gist of the proceedings that was reported as well as the email communications, it is clear that that the conference was a success and its basic purpose - establishment of the LEGAL FORUM with a focused agenda - has been achieved. Lots of critical information have also been shared. I am sure Legal Forum is proceeding as per the agenda and setting up meetings with CJI and also pursue other actions.

In this context I would like to revive what I had said at the early stage of exchange of communication on the conference. That was to mobilise men and material to put pressure on the politicians and parliamentarians to either repeal the SARFAESI Act or the substantially amend the same to be in consonance with the Constitution and fundamental rights.

All of you may be aware that the BJP led government in the centre had enacted two draconian Acts in 2002. One was POTA that was passed in a combined session of parliament during the budget session. This was to prevent 'physical terrorism' and to empower the inept police force for the purpose.. The other was SARFAESI Act, rushed through in the winter session. This was to promote 'monetary terrorism' and to empower greedy bankers for the purpose.

There were serious complaints of gross misuse and abuse of of POTA leading to its repeal in 2005. Now there are several reported cases of gross misuse and abuse of SARFAESI Act by the banks and their 'securitisation' agents. Since there is no political outcry against SARFAESI Act there is need to raise voice on behalf of the Small Scale Entrepreneurs who actually are the worst sufferers.

As a first step I am in the process of drafting a comprehensive memorandum to be addressed to the President, Vice President, Prime Minister, Speaker of Lok Sabha and Leader of the Opposition adducing compelling reasons either to repeal the law in toto or to substantially amend the provisions of the Act that has turned banks into 'shylocks'!

For the purpose I would require specific case studies of gross misuse or abuse of the SARFAESI Act and manipulation of the DRT/legal mechanism by the banks and their agents. If you agree you may mail these 'case studies' to me that should be descriptive at the same time as brief as possible.

Regards,

M.G.Devasahayam

Dear Mr Ram Kishanji

Sorry for my late comments, but it was great to be in the two days conference of DRT Solutions. This has given us vide range of solutions to the problems which Banks create or people around you make you understand that bank can create. It is indeed remarkable work in this line of democracy where the burocratic system has made life of Entrepreneurs difficult. It is indeed remarkable work for the people who are suffering due to deeds of banks.

The reading material of the conference and also the presentation was to the point and had many many tools to fight the system back. The overall arrangement  was excellent and we enjoyed every moment of it. Meeting people from different parts of the country with similar problems, and knowing them, interacting with them was a great experience.

We once again Thank You Ram Kishanji for making us a part of this conference and congratulate you and your team for the efforts.

Best Regards

Respected Sir

I have attended the unique conference organized by the legal forum of India. Being an advocate I can say that you have understood and pin pointed the problems of an advocate and the problems of the court. Now –a-days courts are overburdened and they had already fixed their certain notions. Only solution as you have rightly gathered is perfect pleading and complete material with the use of latest technology in trial court through which we can get relief in our favor as a right, not on mercy. Your views on use of latest technology in judiciary are eye-opener. I hope Govt of India State Govt. and Supreme court will consider and take a positive steps in implementation of your valuable views. I had seen lots of cases defeating in Higher courts only on the count of improper pleading of all the necessary and relevant facts and improper defense

Your work and theory is the need of time May you live long

                                    With regards

                                                            Yours faithfully

Dear Mr. Ram Kishan,

I wish all success to Legal Forum of India. My son Mr. Ambrish Tiwari, Law Officer, Idea Cellular will attend the conference on my behalf.

When we met in January 2008, I read your drafts for many DRT cases, counter claims, written statements, plaints and various other applications. I took print outs of some of your drafts with me.

During the Thirty-Seven years of my services as Judge to Madhya Pradesh Judiciary, I came across drafts by thousands of lawyers, but rare of these were satisfactory in my personal opinion. Drafting a case is crucial to present the case, framing the issues, understanding the evidences and passing an appropriate judgment.

Drafting is an art and it is very rare nowadays. I find your style very systematic, sequentially arranged, rational, detailed and easy to understand the case in whole. It is the style and the way one case should be prepared and present before the court.

The Legal Forum of India is the platform to spread out the awareness for art of drafting.

All the best to you and your associates.

Keshav Prasad Tiwari

Dear Sir,

Thanks a lot for inviting me to attend the conference.  The conference is so fabulous that i could not explain in words.  You and Dubey G and Mr. Mallik are the real teachers of the show. Teaching the wrong doings of the bank would have helped most of the industrialist who came to attend the conference its really great and has created confidence in them to handle the case.  In your absence in the conference most of the individuals appreciated your hard work and enthusiam and stated you as a guru. And i too told them you are my guru G.

Two things i learnt from the conference one is the dedication towards the case we handle and another is the counter claim. I really learnt a lot from the conference thanks a lot.

Regards,

Yours ever loving Arun

"Life affords no higher pleasure than that of surmounting difficulties, passing from one step of success to another , forming new wishes and seeing them gratified. He that labors in any great undertaking has his fatigues first supported by hope and afterwards rewarded by joy." I remembered the aforesaid saying of Samuel Jhonson after attending the conference. I know how you started your tirade against injustice by banks years ago and all alone and to day it has become a movement for the benefit of the honest entrepreneurs. The conference was a revelation to me to know that so much of manupulation of Law has taken place in the banking sector. I pledge my support for your great movement. I wish you all success.

I take this opportunity to express my thanks to you and your associates for hosting the august conference at Indore on Borrowers defences. Borrowers have for long been suppressed by the mighty banking fraternity. The formation of the Legal Forum of India has given hope to helpless victims of the existing system. Sir, as I am in the process of preparing to apply for damages, I appreciate your advise that the pleadings have to be perfect with evidences. Can I request for your advice on the document, when ready, for any weak areas. I wish your mission many challenging victories.

Congratulations for the success of the conference. The efforts made by you is one step ahead. I can easily imagine the events of the conference with your ideas but only disappoint of mine is not attending it. The duration of the conference is insufficient and place of the conference is little inconvenience at the National level. In the North Mumbai or Delhi will be ideal place. In the South Chennai or Hyderabad will be suitable. This is only begining and I hope with the passage of time it is going to attract thousands of people all over India and several conference will take place in different parts of the country with your Legal Forum. The Legal Forum of yours should become "Father of Legal Forum" in the country to fight against the Banks and should be land mark in the history of DRT and DRAT.It is going to be great shelter  for innocent borrowers who are all suffering in the hands of Bankers.

Dear RamKishanji,

It was ever so nice meeting with you and your team during the recent
conference at Indore. The contents, the topics and the in-depth researched
papers all made it for an excellent insight into the ways and means for
tackling the DRT matters for the guarantors.

Though my own matter has been sorted out to my satisfaction with the
allowing of my appeal by the DRAT, Chennai, setting aside the DRT order
strapping liability for payment on me; I have now decided to take your
expert advise and help in the matter of taking on the Bank further in the

I will be writing to you separately on this matter in the coming days.

Once again thanks for the insightful and memorable get-together.

Application of Law of Torts in claiming Damages from Municipal Corporations for demolition of structures, closure of shops etc:- In many parts of the country, the Municipal Corporations are demolishing structures like shops and houses which existed for number of years. The shops existing for number of years are proposed to be shut down. The affected persons should claim Damages under the Law of Torts, which would be substantial. It is learnt that in Delhi itself about 5 lac shops are to be closed down and about 25 lac persons would be out of jobs. All these persons should file damage suits in the civil court. Since the damages would be substantial, the suits may be filed as Indigent Persons. Since the damages would attract interest, the usual delay by the civil courts will not affect the final outcome. The affected shop owners may discuss the details with us on phone.
